Terms of Use (EULA)

These Terms of Use ("Terms") are a legal agreement between you and CardioSurf ("we", "us") governing your use of the CardioSurf mobile application (the "App"). Please read them carefully. By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of terms

By creating an account or otherwise using the App, you confirm that you can form a binding contract, that you accept these Terms, and that you agree to our Privacy Policy. If you do not agree, do not use the App.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded or other supported devices that you own or control, for your own personal, non-commercial use. This license is also subject to the Apple Licensed Application End User License Agreement (EULA), which applies to apps distributed via the App Store; where these Terms and the Apple standard EULA conflict, the more protective terms for you as an end user apply to the App Store distribution.

3. Subscriptions and purchases

CardioSurf offers optional in-app purchases, which may include:

  • Monthly and Yearly auto-renewable subscriptions; and
  • A Lifetime one-time purchase.

The following applies to auto-renewable subscriptions:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
  • You can manage or cancel your subscription in your device's App Store account settings after purchase. Turning off auto-renew stops future charges; the current period remains active until it expires.
  • Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.

The Lifetime option is a one-time purchase that unlocks premium access for the supported lifetime of the App on your account. Purchases and billing are processed by Apple; pricing is shown in the App before you buy. Except where required by law or by Apple's policies, purchases are non-refundable. Refund requests are handled by Apple.

4. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under it. Provide accurate information and keep it up to date. You may delete your account at any time from within the App.

5. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by law;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
  • Resell, sublicense, or commercially exploit the App without our permission.

CardioSurf is a physical exercise game. Before starting this or any exercise program, consult a physician or qualified health professional, especially if you are pregnant, have a medical condition, or have any doubt about your fitness to exercise.

  • You participate entirely at your own risk.
  • Make sure you have a clear, obstacle-free space around you, with secure footing and enough room to jump, duck, and step in all directions.
  • Stop immediately if you feel pain, dizziness, shortness of breath, or discomfort.
  • The App is not medical advice and is not a substitute for professional medical care, diagnosis, or treatment.

6. Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that movement detection will be accurate in all conditions. To the extent any warranty cannot be disclaimed under applicable law, it is limited to the minimum period allowed.

7. Limitation of liability

To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or personal injury arising out of or relating to your use of (or inability to use) the App, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months preceding the claim, or, where no amount was paid, to the minimum amount permitted by law.

8. Termination

You may stop using the App at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or other users. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and license restrictions) will survive.

9. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the App provider is established, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection laws apply to you. [App provider to specify governing state/country before publication.]
